Clery Act Crimes
The Clery Act requires our institution to disclose three general categories of crime statistics:
Criminal Offenses
Hate Crimes, and
Arrests and Disciplinary Referrals for Weapons, Drug and Liquor Laws
Criminal Offenses
CRIMINAL HOMICIDE
- Murder and Nonnegligent Manslaughter
- Manslaughter by Negligence
Criminal Homicide—Murder and Nonnegligent Manslaughter
Definition: The willful (nonnegligent) killing of one human being by another.
Criminal Homicide—Manslaughter by Negligence
Definition: The killing of another person through gross negligence.
FORCIBLE RAPE
- Rape by Force
- Attempts to Commit Forcible Rape
Forcible Rape—Rape by Force
Definition: The carnal knowledge of a female forcibly and against her will.
Forcible Rape—Attempts to Commit Forcible Rape
Assaults or attempts to forcibly rape are classified as Attempts to Commit Forcible Rape.
ROBBERY
- Firearm
- Knife or Cutting Instrument
- Other Dangerous Weapon
- Strong-arm—Hands, Fists, Feet, etc.
Definition: The taking or attempting to take anything of value from the care, custody, or control of a person or persons by force or threat of force or violence and/or by putting the victim in fear.
ASSAULT
Definition: An unlawful attack by one person upon another.
Aggravated Assault
Definition: An unlawful attack by one person upon another for the purpose of inflicting severe or aggravated bodily injury. This type of assault usually is accompanied by the use of a weapon or by means likely to produce death or great bodily harm.

Definition: The unlawful entry of a structure to commit a felony or a theft.
MOTOR VEHICLE THEFT
- Autos

- Other Vehicles
Definition: The theft or attempted theft of a motor vehicle.
ARSON
- Arson—Structural
- Arson—Mobile
- Arson—Other
Definition: Any willful or malicious burning or attempt to burn, with or without intent to defraud, a dwelling house, public building, motor vehicle or aircraft, personal property of another, etc.
Hate Crimes
The second category of statistics that must be disclosed is hate crimes. A hate crime is a criminal offense committed against a person or property which is motivated, in whole or in part, by the offender’s bias. Bias is a preformed negative opinion or attitude toward a group of persons based on their race, gender, religion, disability, sexual orientation or ethnicity/national origin.
For Clery purposes, hate crimes included all criminal offensives listed above and the additional offensives listed below.

Definition: The unlawful taking, carrying, leading, or riding away of property from the possession or constructive possession of another.
Pocket-picking
Definition: The theft of articles from a person by stealth where the victim usually does not become immediately aware of the theft.
Purse-snatching
Definition: The grabbing or snatching of a purse, handbag, etc., from the custody of an individual.
Shoplifting
Definition: The theft by a person (other than an employee) of goods or merchandise exposed for sale.
Theft From Motor Vehicles (Except Theft of Motor Vehicle Parts and Accessories)
Definition: The theft of articles from a motor vehicle, whether locked or unlocked.
Theft of Motor Vehicle Parts and Accessories
Definition: The theft of any part or accessory attached to the interior or exterior of a motorvehicle in a manner that would make the part an attachment to the vehicle or necessary for the operation of the vehicle.
Theft of Bicycles
Definition: The unlawful taking of any bicycle, tandem bicycle, unicycle, etc.
Theft From Buildings
Definition: A theft from within a building that is open to the general public and where the offender has legal access.
Theft From Coin-operated Device or Machine
Definition: A theft from a device or machine which is operated or activated by the use of a coin.
All Other Larceny-theft Not Specifically Classified
Definition: All thefts which do not fit the definition of the specific categories of larceny listed above.
SIMPLE ASSAULT
Definition: All assaults which do not involve the use of a firearm, knife, cutting instrument, or other dangerous weapon and in which the victim did not sustain serious or aggravated injuries.
- Assault and battery
- Injury caused by culpable negligence
- Coercion, and
- All attempts to commit these offenses.
INTIMIDATION
Definition: To unlawfully place another person in reasonable fear of bodily harm through the use of threatening words and/or other conduct, but without displaying a weapon or subjecting the victim to actual physical attack.
- Cyber-intimidation
DESTRUCTION / DAMAGE / VANDALISM OF PROPERTY
Definition: To willfully or maliciously destroy, damage, deface, or otherwise injure real or personal property without the consent of the owner or the person having custody or control of it.
- Cutting auto tires
- Drawing obscene pictures on restroom walls
- Smashing windows
- Destroying school records
- Defacing library books
Arrests and Disciplinary Referrals for Violation of Weapons, Drug and Liquor Laws
Arrest is defined as persons processed by arrest, citation or summons.
Referred for disciplinary action is defined as the referral of any person to any official who initiates a disciplinary action of which a record is kept and which may result in the imposition of a sanction.
WEAPONS: CARRING, POSSESSING, ETC.
Definition: The violation of laws or ordinances prohibiting the manufacture, sale, purchase, transportation, possession, concealment, or use of firearms, cutting instructments, explosives, incendiary devices or other deadly weapons. This classification encompasses weapons offenses that are regulatory in nature.
- Manufacutre, sale, or possession of deadly weapons
- Carrying deadly weapons, concealed or openly
- Using, manufacturing, etc., of silencers
- Furnishing deadly weapons to minors
- Aliens possessing deadly weapons
- Attempts to commit any of the above
DRUG ABUSE VIOLATIONS
Definition: The violation of laws prohibiting the production, distribution and/or use of certain controlled substances and the equipment or devices utilized in their preparation and/or use. The unlawful cultivation, manufacture, distribution, sale, purchase, use, possession, transportation or importation of any controlled drug or narcotic substance. Arrests for violations of state and local laws, specifically those relating to the unlawful possession, sale, use, growing, manufacturing and making of narcotic drugs.
- All drugs, without exection, that are illegal under local or state law where the institution/campus
- All illegally obtained prescription drugs
LIQUOR LAW VIOLATIONS
Definition: The violation of state or local laws or ordinances prohibiting the manufacture, sale, purchase, transportation, possession or use of alcoholic beverages, not including driving under the influence and drunkeness.
- The manufacacture, sale, transporting, furnishing, possessing, etc., of intoxicating liquor
- Maintaining unlawful drinking places
- Bootlegging
- Operating a still
- Furnishing liquor to a minor or intemperate person
- Underage possession
- Using a vehicle for illegal transportation of liquor
- Drinking on a train or public conveyance
- Attempts to commit any of the above
